Pandemia y voto parlamentario telemático

    Partiendo de la concepción del voto telemático como excepción a la presencialidad consustancial a las cámaras parlamentarias, el trabajo examina la evolución que ha experimentado la regulación de esta forma de votación en el Congreso de los Diputados y el Senado y en los parlamentos autonómicos, de cuyos reglamentos siete fueron objeto de reforma en la materia en el año 2020. El análisis de estas reformas, así como de las más recientes normas de desarrollo, revela que algunos avances se han producido para intentar resolver problemas inherentes al voto telemático, derivados fundamentalmente de su carácter previo respecto de la votación presencial. Aun así, pese al uso intensivo y extensivo que se ha hecho del mecanismo durante la pandemia, las lecciones aprendidas –más allá de resolver algunas dificultades técnicas– no se reflejan plenamente en la normativa. Por constituir una excepción a la regla general de la presencialidad parlamentaria, la regulación del voto telemático debe contemplar el mayor número posible de los problemas que suscita su aplicación, y, sin embargo, muchos de los detectados durante la pandemia siguen sin resolver.

    On the basis of the conception of telematic remote vote as an exception to the attendance inherent in the Parliamentary Chambers, this paper analyses the evolution suffered by the regulation of this form of voting in the Congress of Deputies and the Senate and in the Regional Parliaments, of whose Regulations seven were subject to reform in this matter in the year 2020. The analysis of these reforms, as well as of the most recent implementing rules, reveals that some progress has been made in trying to solve problems inherent to telematic vote, derived mainly from being prior to the in-person voting. Even so, despite the intensive and extensive use of the mechanism during the pandemic, the lessons learned –beyond solving some technical difficulties– have not been fully incorporated into the rules. As an exception to the general rule of parliamentary attendance, the regulation of telematic voting should cover as many problems as possible that arise from its application, yet many of those identified during the pandemic remain unresolved.

    Bozketa telematikoa parlamentu-ganberek berezkoa duten presentzialtasunaren salbuespen gisa hartzen duen ikusmoldetik abiatuta, lan honek bozketa-modu horren erregulazioak Diputatuen Kongresuan eta Senatuan eta parlamentu autonomikoetan izan duen bilakaera aztertzen du, 2020an horietako zazpi erregelamendu aldatu baitziren gai horretan. Erreforma horien eta garapen-arau berrienen azterketak erakusten duenez, aurrerapen batzuk boto telematikoari datxezkion arazoak konpontzen saiatzeko egin dira, batez ere bozketa presentziala baino lehenagokoa izateagatik. Hala ere, pandemian mekanismoa modu intentsiboan eta estentsiboan erabili den arren, ikasitako irakaspenak –zailtasun tekniko batzuk konpontzeaz harag– ez dira guztiz islatzen araudian. Parlamentuko presentzialtasunaren arau orokorraren salbuespena denez, boto telematikoaren erregulazioak hura aplikatzeak sortzen dituen ahalik eta arazo gehien jaso behar ditu, baina pandemian detektatutako asko konpondu gabe daude oraindik.
