  La reproducción facsimilar, relativa a la existencia de copias de instrumentos obtenidas por medio de fax, plantea desde el punto de vista jurídico diversos problemas que es preciso plantear y atender a una solución. Principalmente, desde el punto de vista substantivo, resulta necesario esclarecer su naturaleza jurídica, atendiendo a si se trata de actos civiles o comerciales buscando la legislación aplicable; en segundo término, se plantean problemas probatorios, aspectos contractuales -formación de consentimiento, momento y lugar para ello- y las responsabilidades de los sujetos intervinientes. Formalmente, es preciso determinar elementos destinados a otorgarle mayor certeza al uso del fax, como el papel usado, los registros, la utilización de códigos secretos o crípticos. A todo elle, se atiende en el presente trabajo, buscando una contribución a su elucidación. Esperamos, de algún modo, lograrla adecuadamente.

  The facsimile reproduction connected to the existence of instruments received by fax machines reveals, from a legal point of view, several problems that should betaken into account and deserve a solution. Mainly, from a substantive point of view, it is necessary to light up its legal nature specifying whether we are referring to commercial or civil events and so finding the most suitable legislation; on the other hand, there are other evidential and contractual problems, the initiation of consent, time and place for it and the other hand, there are other evidential and contractual problems, the initiation of consent, time and place for it and the responsibilities of the involved individuals. Formally, it is essential to specify elements that are intended to give a more effective use of the fax machines like the paper used, the register; and the use of secret codes. The essay tries to explain this issue. We really hope, somehow, to achieve it in the most effective way.
