    La acción reivindicatoria se presenta en el artículo 348 del Código civil español como el medio de defensa principal contra los ataques que en su titularidad se le produzcan. Tanto es así que sin dicha acción el contenido esencial del derecho de propiedad desaparecería, quedando el propietario sin una de las facultades que caracterizan el dominio pleno sobre un bien. La propiedad sobre los bienes de la naturaleza histórica y artística está delimitada por la función social que dichos bienes tienen a favor de la sociedad. Sin embargo, la acción reivindicatoria sigue siendo el medio fundamental para conseguir la restitución de las obras de arte ilícitamente de su patrimonio.

    The reivindicatory action is contained in Article 348 of the Spanish Civil Code and is the principle means of defense against attacks on title that may arise. Without said action, the essentials of property rights would dissapear, leaving the property owner without one of the elements that characterize full control over his property. The ownership over historical and artistic property is limited by the social function that the property provides society. Nevertheless, the vindicatory action continuesto be the basic means of obtaining restitution of works of art illegally removed from their heritage or place of origin.
