La iurisdictio mandata: un proceso de adaptación

    El estudio de los problemas específicos en torno a la iurisdictio mandata es instrumental para la comprensión de la iurisdictio en general. El desarrollo de esta figura parte de la época republicana, con los praefecti iure dicundo nombrados por el pretor. La diversificación del uso de este título en época tardorrepublicana y a comienzos del Principado para referirse a figuras de diverso tipo es un signo de la madurez alcanzada por la institución tras dos siglos de existencia. Por otro lado, la disociación de imperium e iurisdictio como aspecto específico de éste podría haberse producido en época republicana, si damos crédito a las teorías que hablan del ejercicio de funciones exclusivamente jurisdiccionales por los praefecti iure dicundo nombrados por el pretor republicano. Este hecho puede contribuir a la aclaración de las categorías severianas en torno a la relación entre imperium e iurisdictio.

    The research on the specific problems around the iurisdictio mandata is instrumental to the general understanding of the iurisdictio. The development of this issue starts from the Republican period, with the praefecti iure dicundo appointed by the praetor. The diversification of the use of this title in the Late Republic and the first years of the Principate regarding different offices is a sign of the maturity reached by the institution after two centuries of existence. At the other hand, the splitting of imperium and iurisdictio as an specific aspect of imperium could have been born in the Republican period, if we pay heed to the theories that assert the exercise of exclusively jurisdictional functions by the praefecti iure dicundo appointed by the Republican praetor. This fact can contribute to shed light on the severian cathegories regarding the connection between imperium and iurisdictio.
