  In the more recent period the Council of State has tried hard to build a harmonious relationship with the European Court of Justice. This has entailed a restriction of its sovereign power of decision in important domains. But it would be wrong to believe that this has necessarily meant a loss of power. To the contrary, this increased European orthodoxy could well allow the French judges to maintain and develop the considerable power and freedom they have acquired during the last twenty years.

  Le Conseil d’État a beaucoup travaillé, dans la période récente, à la construction d’une harmonie profonde avec la Cour de justice des Communautés. Cela emporte un reflux de sa souveraineté décisionnelle dans certains domaines importants. Mais on aurait tort de croire qu’il en résulte nécessairement une perte de puissance. Tout au contraire, ce surplus d’orthodoxie communautaire pourrait bien permettre au juge français d’entretenir et de développer la liberté et le pouvoir – considérables – qu’il a acquis au cours des vingt dernières années.
