    The Environment Charter has been presented by some as a political gadget. Its drafting and its adoption have been accompanied by legal disputes regarding its actual reach. Yet, having to deal with a new societal problem, it should not come as a surprise that the elaboration and content of the Charter should have gone beyond the beaten track. The Charter is innovative both in its form and its content, notably when it asserts a human right to the environment. Its normative dimension, which has been questioned because of its form, will eventually become a reality: it is indeed a constitutional document that will impose itself to all and that entails promising developments for future generations although these are yet to be known.

    La Charte de l’environnement a été présentée par certains comme un gadget politique. Sa préparation et son adoption ont donné lieu à des controverses juridiques quant à sa portée réelle. Mais, s’agissant d’un problème de société inédit, il n’était pas étonnant que la Charte sorte des sentiers battus en ce qui concerne son élaboration et son contenu. Innovante dans la forme et dans le fond, notamment en proclamant le droit de l’homme à l’environnement, sa normativité, mise en doute du fait de ses apparences, va se transformer en une réalité : il s’agit bien d’un texte constitutionnel s’imposant à tous et porteur de développements prometteurs pour les générations futures, mais souvent encore mystérieux.
