    The Constitutional Amendment 54 (September 20th, 2007) modified the article 12, I, �c� that deals with the potestative nationality. Now beyond the option of residence in Brazil, the person can require its nationality in the diplomatic department. The revisional constituent aimed to protect the rights of human being dignity (article 1º, III). The Constituent Derivative Power added the article 95 to the Transitory Constitutional Provisions Act, but the option occurs at 18 years.

    A EC nº 54 de 20, de setembro de 2007, alterou o art. 12, I, �c�, que trata da nacionalidade potestativa. Agora, além da opção de residência no Brasil, a pessoa pode requerer sua nacionalidade em repartição diplomática. Visou o constituinte revisional a proteger o direito da dignidade da pessoa humana (art. 1º, III, da CF). O Poder Constituinte derivado acrescentou o art. 95 ao ADCT, mas a opção ocorre aos 18 anos.
