El hábeas corpus ha surgido históricamente como una barrera contra el abuso del Poder. Pero la acción, además de cargar con cierta ineficacia ante la falta de resolución a viejos problemas, particularmente en América Latina, enfrenta hoy nuevos desafíos y cuando ellos son además amenazantes, la tendencia a la expansión estatal es una realidad, como lo es la reducción de su escudo.
El artículo intenta plantear a la garantía como el freno natural para un adecuado balance institucional. Propone para ello la redefinición de la ecuación de emergencia, acción y reacción, en lo teórico, y más dinámica en la interpretación del hábeas corpus, en la práctica

The habeas corpus has arisen historically like a barrier against the abuse of the Power. But the action, besides to load with certain inefficiency the lack of resolution of old problems, particularly in Latin America, it faces new challenges today and when they are in addition threatening, the tendency to the state expansion is a reality, as it is it the reduction of his shield.
