La inmigración es fundamental para mantener nuestra actividad en determinados sectores económicos. El Estado Social y Democrático de Derecho, debe reconocer al ciudadano extranjero el �derecho humano universal a emigrar�. El artículo 318 bis del Código Penal protege los derechos humanos de los ciudadanos extranjeros, ya que el tráfico ilegal o la inmigración clandestina de personas vulneran la dignidad humana. El tráfico de mujeres con fines de explotación sexual es un fenómeno que corre parejo al incremento de la inmigración ilegal. Entre los sectores clave de la delincuencia organizada se encuentra la �trata de personas� y el �tráfico de inmigrantes�. En la lucha contra la inmigración ilegal es fundamental tener presente a las mafias y cómo engañan a los inmigrantes. La política criminal del referido precepto responde al objetivo de limitar o controlar los flujos migratorios.

Immigration is essential in order to maintain activity in certain sectors of the economy. A social and democratic State subject to the rule of law must recognise a foreign citizen�s �universal human right to migrate�. Article 318b of Spanish criminal law protects the human rights of foreign citizens since the illegal trafficking of persons or clandestine migration violates human dignity. The trafficking of women for the purposes of sexual exploitation is a phenomenon which has developed in parallel with the rise in illegal migration. �Human trafficking� and �migrant trafficking� are key sectors of the activities of organised crime. In the struggle against illegal migration, it is essential to be aware of these organised crime rings and how they deceive migrants. The policy objective underlying the aforementioned legal provision is to limit or to control migratory flows.
