El artículo se centra en la patria potestad, que supuso, en España, un obstáculo para proteger a los niños y niñas de los malos tratos que sufrían. Se analiza el discurso generado por juristas y reformadores sociales, quienes coincidían en denunciar la incapacidad de los tribunales para perseguir los abusos, y exigían, por esta razón, la reforma del Código Civil y el Código Penal.
This paper is centred in the paternal authority that supposed, in Spain, an obstacle to protect children and girls of the child abused that suffered. The speech is analyzed generated by jurists and socials reformers who coincided in denouncing the inability of the tribunals to pursue the abuses and they demanded, for this reason, the reformation of the civil Code and the penal Code.
