Tugendhat señala que la única forma de fundamentar racionalmente la moral consiste en que el individuo pueda ofrecer, tanto a los demás como a sí mismo, buenas razones para observar las normas morales, mientras que la fundamentación de las normas por sí mismas carece de sentido. Tugendhat considera que las normas morales están fundamentadas si son igualmente buenas para todos, pero reconoce que esta concepción moral debería ser asimismo fundamentada. Este segundo nivel de fundamentación lo afronta Tugendhat a través de su discusión con Habermas.

Tugendhat states that the only way the morality be rationally justified consist that the individual, he can offer himself and the others good reasons to observe the moral rules, while the fundamentation of the rules in itself has no sense.
Tugendhat considers that the moral rules are justified when they are equally good for all individuals, but he recognizes that this moral conception should be justified as well. This second level of fundamentation is faced by Tugendhat in his discussion with Habermas
