Visión panorámica del constitucionalismo en el siglo XX

    Este estudio presenta una visión panorámica de las presiones y los profundos cambios que experimentó el constitucionalismo durante el siglo XX, cambios comprensibles a la vista de las grandes transformaciones políticas, económicas, sociales, culturales y científicas que vivió el mundo en este siglo. Sin el propósito de hacer una enunciación detallada, es posible identificar las tendencias dominantes del constitucionalismo durante el siglo XX a través de una visión de cuestiones centrales en los debates sobre cuatro conceptos esenciales del constitucionalismo: 1) el Estado y, en él, elementos atinentes al concepto de soberanía, secularización, relaciones entre el derecho internacional y el derecho nacional, la integración supranacional, la dimensión del Estado, el Estado de Derecho, los límites del Derecho, el Estado de bienestar y los flujos financieros internacionales, 2) la sociedad y, con ello, cuestiones referidas a derechos fundamentales, dignidad, derechos de las minorías, derechos de los indios, derecho a la información, regulación de procesos científicos y clínicos y protección de derechos, 3) el poder cuyo debate plantea cuestiones referidas a los sistemas de gobierno y el sistema representativo, el control político y el control financiero, los derechos de la oposición, la democracia semidirecta, el control jurisdiccional, el federalismo y el regionalismo, el municipalismo, los órganos de relevancia constitucional y los órganos de gobierno, y por último 4) la constitución y, con ella, los problemas derivados de su función reguladora y la reforma constitucional.

    This paper presents an overview of the pressures and the profound changes which have interested constitutionalism during the twentieth century. We can understand these changes only taking into account the great political, economic, social, cultural and scientific transformations the world has lived during this century. Without the purpose of elaborating a detailed statement, we can identify the dominant trends of twentieth century Constitutionalism, through an overview of central issues, objects of the debates regarding four essential concepts of the Constitutionalism: 1) the State and, in it, the relevant elements regarding sovereignty, secularism, the relationship between the international and national Law, the supranational integration, the dimension of the State of Law, the limits of the Law and the international financial flows; 2) the society and with it, the issues concerning the fundamental rights, dignity, minorities´ rights, the rights of indigenous peoples, the right to information, the regulation of scientific and clinical processes and the protection of rights; 3) the power, which debate raises questions about the government systems and the representation systems, the political and the financial control, the right of the opposition, the semi-direct democracy, the judicial review, the federalism and the regionalism, the local government, the relevant constitutional bodies and the governing bodies, and, finally, 4) the Constitution and, with it, the problems derived from its role as regulator and the constitutional reform.
