Este artículo constituye un comentario crítico a la Sentencia de la Corte Constitucional C-537 de 2010 y, en concreto, a los argumentos desarrollados por la Corte para declarar la constitucionalidad condicionada del artículo 24 de la Ley 1340/2009.
El comentario se estructura a partir del estudio de los principales temas que aborda la sentencia: En primer lugar, el sistema o modelo de aplicación de las normas de libre competencia vigente en Colombia y, en segundo lugar, el valor del precedente administrativo y su regulación a través de la figura de la «doctrina probable».
This document contains a constructive critique of Decision C � 537 of the Colombian Constitutional Court. It deals particularly with the arguments used by the Court to declare the conditional constituonality of Art. 24 of Law 1340/2009.
The commentary is structured departing from the study of the principal subjects dealt with in the Decision: firstly, it deals with the "model" or "system" for the aplication of the free competition regulations currelty in force in Colombia and, secondly, it studies the value of the administrative precedent and its regulation through the so-called "probable doctrine".
