    • Gratian probably composed distinction 3 of the De penitentia in order to rectify what he thought were shortcomings and doctrinal errors in the early scholastic treatise Baptizato homine. This hitherto unstudied tract on penance (edited in the appendix) provides only a lukewarm defense of the repeatability of penance and seems to endorse the view that sinners can perform penance for one sin while continuing to indulge in other sins. Gratian took exception to these positions because he believed strongly in God's complete holiness and will to make others holy. In distinction 3 of the De penitentia, Gratian critiques the arguments and authorities considered in Baptizato homine. Through a more refined analysis , he is abale to provide an unambiguous defense of the repetability of penance and to show that sinners must perform penance for all their sins. Gratian's desire to increase the dissemination of his critique may explain why he inserted the tract De penitentia into the Decretum.
