Corpus Evangelicorum und Corpus Catholicorum: Die Wahrnehmung der Korporativen Reichspolitik in juristischen Dissertationen der Frühen Neuzeit

    • The object of the present examination is the perception of corporate politics in the Holy Roman empire (Corpus Evangelicorum/Corpus Catholicorum) in early modern juridical dissertations. The question is addressed as to what kinds of problems and controversies are discussed in these dissertations and to what extent the dissertations may have influenced or shaped the progress of differring juridical positions. Initially, the chronological development and confessional background of the dissertatins are examined. This results in the conclusion that the first dissertations treating aspects of corporate politics were written in the beginning of the 18th century, principally by protestant jurists. The second part of the article highlights specific problems that are closely connected with corporate politics, including legality and constitution of the Corpus Evangelicorum, itio in partes and vota communia. In the course of this analysis, different ways of argumentation are identified that are characteristic of both Protestant and Catholic jurists. The results of this analysis are then discussed in the context of 18th century public law in order to reveal the significant influence of dissertations on juridical discourse. Therefore, this examination concludes that dissertations play an important role in the differentiation of juristic positions.
