Resumen de La reparación integral de perjuicios en Colombia: consideraciones legales y jurisprudenciales

Este artículo de reflexión busca analizar los aspectos normativos y jurisprudenciales de la rebaja de pena por reparación del daño e indemnización de los perjuicios causados, para los delitos contra el patrimonio económico, partiendo de la premisa que se trata de un derecho consagrado por la ley en favor del procesado que debe ser garantizado por el funcionario judicial señalando además que la víctima, no puede oponerse a la apertura de este trámite. Entendiendo por victima las personas naturales o jurídicas y demás sujetos de derechos que individual o colectivamente hayan sufrido algún daño directo como consecuencia del injusto. El Juez en este asunto debe mostrar una discrecionalidad razonada que no puede confundirse con arbitrariedad, el servidor judicial a la hora de fijar una rebaja de pena, debe sustentarse adecuadamente La argumentación en la medida de lo posible deberá ser breve y concisa pero sólida y coherente

This is to examine the regulations and jurisprudential aspects concerning the reduction of penalty on reparation and compensation for damage caused by crimes to the economy against property. This is based on the premise that it is a right enshrined by law in favor of the defendant to be guaranteed by the judicial officer also pointing out that the victim can not oppose the opening of this procedure. Victims are the natural or legal persons and other subjects of rights that individually or collectively have suffered harm as a direct result of a crime. The judge in this case must apply a reasoned discretion that should not be confused with arbitrariness. Moreover, when setting a reduction of penalty, the judicial assistant must be supported by an adequate and accurate argument. This argument has to be brief and concise as possible, but it has to be solid and consistent.
