    A result of a slow historical construction whose legislative foundations go back to the end of the 19th century, our public law on gambling reveals a form of state oversight which consists in qualitative and quantitative control of the availability of games on the territory. While not questioning the foundations of this system, the May 12, 2010 law has introduced a legal control of an online gambling industry that has so far developed at the margin of state intervention. By so doing it has initiated a redefinition of the regulatory framework of gambling and allowed the emergence of a general law regarding this industry.

    Produit d’une lente construction historique dont les fondements législatifs remontent à la fin du xixe siècle, notre droit public des jeux révèle une forme de maîtrise étatique reposant sur le contrôle à la fois qualitatif et quantitatif de l’offre de jeu dispensée sur le territoire. Sans remettre en cause les fondements de ce système, la loi du 12 mai 2010, tout en procédant à l’encadrement légal d’un secteur des jeux en ligne qui s’est essentiellement développé en marge de l’intervention de l’État, a procédé à une recomposition du paysage de la régulation des jeux et permis l’émergence d’un droit commun le concernant.
