Este estudio analiza la articulación jurídica de las áreas metropolitanas en Andalucía. Se parte de la constatación de la superación de las fórmulas pesadas de gobierno metropolitano, y la necesidad de buscar alternativas más flexibles. El fracaso del Área Metropolitana, como entidad local (43 LBRL), se compensa acudiendo a fórmulas jurídicas alternativas, en principio no diseñadas inicialmente para este fin, pero que están demostrando ser igualmente útiles y eficaces. Entre estas fórmulas alternativas ocupan un lugar propio la planificación territorial, las Mancomunidades de Municipios y los Consorcios locales. La primera por la potencialidad que le supone su carácter transversal e integrador del territorio metropolitano. Los segundos por su carácter asociativo, su voluntariedad y la flexibilidad de su régimen jurídico.
This paper analyzes the legal status of the metropolitan areas in Andalusia. It begins by noting the passing of heavy metropolitan government formulas, and the need to seek more flexible alternatives. The failure of metropolitan area, as a local authority (43 LBRL), can be solved by use of alternatives legal techniques that were not initially designed for this purpose, but are proving themselves equally useful and effective. These alternative formulas should be emphasized the territorial planning, the commonwealth of municipalities and local consortia. The first one for the potential of his transverse character and integrator of the metropolitan territory. The latter by its associative character, on a voluntary basis and the flexibility of their legal status.
