  • Two phenomena characterize the modern world more than any other: dematerialization and de-bordering. Dematerialization is ubiquitous in everyday life, which is increasingly dominated by the incorporeal and the virtual, from software to the internet and electronic money. De-bordering means that state frontiers lose more and more of their importance. De-bordering is reinforced by dematerialization because the “lightness” of incorporeal objects facilitates their transfer across borders. This article describes the challenges that these developments pose for the law and the ways in which it reacts to them.
