  The Public Power, when in judgement, has its prerogatives which creates an specific section of the procedural law called public procedural law. Through this piece of work we aim to investigate the consequences of such specific rules at the jurisdiction effectiveness against the Treasury, since one of the gratests goals of modern procedural doctrine is to give effectiveness to the judicial decisions. It is exposed in this study that the specific rules to the agreement of the Public Treasury in judgement, become ineffective and slow to the jurisdiction, as well as the Public Power�s judicial control, affecting, thus, a range of fundamental principles of constitucional law and administrative.

  O Poder Público, quando em juízo, possui prerrogativas que criam um ramo específico do direito processual chamado de direito processual público. Com este trabalho visamos investigar as conseqüências de tais regras específicas na efetividade da jurisdição contra a Fazenda, visto que um dos grandes objetivos da moderna doutrina processual é o de dar efetividade às decisões judiciais. É exposto no estudo que as regras específicas para o trato da Fazenda Pública em juízo tornam inefetiva e demorada a jurisdição, bem como o controle judicial do Poder Público, atingindo, assim, diversos princípios fundamentais de direito constitucional e administrativo.
