    El derecho a la protección de la salud, consagrado en el artículo cuarto de la Constitución General de la República tiene, por una parte, una connotación programática, a la vez que también se considera garantía individual. Conforme a lo anterior se hace necesario precisar que los errores médicos por negligencia o impericia causados en la prestación de servicios de atención médica en instituciones públicas, no son, por su propia naturaleza, actos violatorios del derecho a la salud. Para comprender la dimensión de este derecho, es preciso tener en cuenta lo que dispone la legislación sanitaria en cuanto a las finalidades que deben cumplir los servicios de salud y los servicios de atención médica, que en conjunto buscan proteger, promover y restaurar la salud de la persona y de la colectividad; de ahí su naturaleza tanto de derecho social como de garantía individual.

    The right to the protection of the health, consecrated in the quarter article of the General Constitution of the Republic has, on one hand, a programmatic connotation, at the same time that it is also considered individual guarantee. According to the above-mentioned it becomes necessary to specify that the medical errors for negligence or imprecision caused in the benefit of medical care services in public institutions, are not, for their own nature, infringing acts of the right to the health. To understand the dimension of this right, it is necessary to keep in mind what prepares the sanitary legislation as for the purposes that should complete the services of health and the medical care services that on the whole look for to protect, to promote and to restore the person�s health and of the collective; of there their so much nature of social right as of individual guarantee.
