El trabajo pretende perfilar a grandes rasgos la evolución de la libertad de testar en las distintas etapas tanto del Derecho inglés como del foral aragonés y resaltar qué similitudes guardan entre sí estos sistemas. Se pone de relieve cómo ambos están inspirados por unos mismos principios, tendentes a la concentración del patrimonial casal en una sola mano y que, por lo tanto, no es difícil encontrar paralelismos abundantes así como multitud de instituciones cuya naturaleza es afín al compartir idénticos objetivos. El hecho de que hayan terminado por converger en unas restricciones flexibles a la autonomía de la voluntad, las pensiones familiares en el Common Law y un derecho sucesorio de alimentos en nuestra tierra, podría servir, además, de inspiración a una futura reforma del Código civil en materia de legítimas.

This paper attempts to outline in broad strokes the evolution of freedom of testation at various historical stages of both the English and Aragonese Law and highlight the similarities between these two legal systems. It stresses how both are inspired by the same principles, aimed at the concentration of wealth in one hand and, therefore, is not difficult to find abundant parallelism as well as many institutions whose nature is akin because of sharing same goals. The fact that they ended up converging in flexible restraints on private autonomy, the family provision in the Common Law and inheritance rights to alimony in our land, could provide, moreover, an inspiration for a future reform of the Civil Code regarding fixed shares.
