In France, judicial control of the law is traditionally considered as violating the theory of the separation of powers. It should, instead, be understood as an implementation of this theory, since it gives judges an “ability to prevent,” conductive to the balance of powers. Regularly implemented by constitutional judges who define its current meaning, the principle of the separation of powers is reinforced by this judicial interpretation which enhances one of the fundamental dimensions of the concept: the protection of the rights of citizens.

Traditionnellement perçu en France comme contrevenant à la théorie de la séparation des pouvoirs, le contrôle de la loi par le juge doit, au contraire, être considéré comme une application de celle-ci en ce qu’il confère au juge une « faculté d’empêcher » propice à l’équilibre des pouvoirs. Régulièrement appliqué par le juge constitutionnel qui en définit la signification actuelle, le principe de séparation des pouvoirs sort rénové de son interprétation jurisprudentielle, laquelle sublime une des dimensions pourtant fondamentales du concept : la protection des droits des citoyens.
