En el ámbito costarricense la falta de acción administrativa �lamentablemente- se ha tornado en una atrofi a constante. Luego de la emisión de varias normas y de diversas reformas legales tendientes a �salvaguardar� la ética y el correcto funcionar del Aparato Administrativo, se ha caído en excesos y se ha fomentado la �Cultura del No Hacer�. Así es, la generalidad de los Funcionarios Público prefi eren NO ACTUAR, pensando que con ello logran minimizar o atenuar las responsabilidades y riesgos que el hacerlo les produce.
Siendo �tal vez- por ello que nuestro Poder Judicial ha tomado una línea jurisprudencial tendiente a hacer ver que �en la Omisión también hay Responsabilidad�.
Y es ante tal panorama real que se procura por este medio el aludir y consignar algunos de los principales fallos emitidos en nuestro ámbito Judicial en materia de Responsabilidad por Omisiones.

In the Costa Rican scope the lack of administrative action � lamentably- has become in a constant atrophy.
After emission of several norms and diverse legal reforms �to safeguard� the ethics and the correct one to work of the Administrative Apparatus, one has fallen in excesses and the �Culture of Not Doing� has been fomented. Thus it is, the majority of the Offi cials Government prefer NOT TO ACT, thinking that with it they manage to diminish or to attenuate the responsibilities and risks that doing it produce to them. Being - such time for that reason that our Judicial Power has taken a jurisprudencial line to make see that �in the Omission also there is Responsibility�. And it is before such real panorama that alluding is procured by this means and to brief some of the main failures emitted in our Judicial scope in the matter of Responsibility default.
