This essay treats Massimo Severo Giannini’s concept of legal system in his writings on the general theory of law. Specifically, a comparison is developed between the ideas of Giannini and those of his teacher, Santi Romano. The goal of the comparison is to highlight the innovations introduced by Giannini so as to be able to appraise him in the context of the present day.
