Is it really necessary to reform the section of the Italian Constitution which regards “Economic rights and duties”? Recent liberalizations have met obstacles in the current text of art. 41 of the Italian Constitution? The article analises the Italian Constitutional discipline for “Economic rights and duties” and describes the “New economic Constitution” and the great change which it has imposed to all European State legal systems. Furthermore, the real obstacle to liberalizations are mentioned.
The conclusion is that the way in which ordinary legislation is adopted should change instead of changing Constitution. Even is a difficult situation as complex as this legislator should ensure transparency and completeness of law-making.
