The European social dialogue in the 1990s: institutional innovations and new paradigms

    Die Autorin beschreibt in ihrem Beitrag die wichtigsten Veränderungen, die sich in den 90er Jahren im sozialen Dialog vollzogen haben. Sie unterscheidet zwei Perioden: Der erste Zeitraum, nach dem Abkommen über die Sozialpolitik von Maastricht im Anhang des Vertrags von Maastricht (1992) hat nicht den Schwung und die Ergebnisse gezeitigt, die von ihm erwartet wurden. Das neuartige institutionelle Instrument der "Kollektivverhandlungen im Schatten des Gesetzes" war zwar in mancher Hinsicht nützlich, trug aber auch zur Schwäche des sozialen Dialogs bei.

    Die zweite Periode - die späten 90er Jahre - war vor allem durch eine beeindruckende Diversifizierung der institutionellen Formen des sozialen Dialogs geprägt, was dazu beitragen müsste, seine Erfolgsaussichten zu verbessern, auch wenn die neuen Formen weniger ehrgeizig sind. Es geht um folgende vier neue Entwicklungen: die Diversifizierung der Diskussionsforen; um die Multiplikation der behandelten Themen; um die Anwendung der offenen Koordinierungsmethode im Rahmen des sozialen Dialogs; und um den Versuch, neue Verbindungen zwischen den verschiedenen Formen und Ebenen des sozialen Dialogs herzustellen.

    Es bleibt offen, ob diese Multiplikation der, Öffnungen', der Diskussionsforen und - themen zu einer Stärkung der beteiligten Akteure und zu besseren Ergebnissen des sozialen Dialogs auf europäischer Ebene führen wird.

    This article describes the major changes undergone by social dialogue in the 1990s. Two distinct periods are covered. The first, following in the wake of the Maastricht Social Agreement annexed to the Maastricht Treaty (1992), did not produce the expected new impetus and results. The novel institutional device of 'collective bargaining in the shadow of the law', though an advantage in some respects, was also a source of weakness for the social dialogue. The most striking feature of the second period, covering the later part of the 1990s, is the impressive diversification of institutional forms of social dialogue, a development that ought to multiply its chances of success, even if the new forms tend to be rather less ambitious. Four main new developments are described:

    Diversification of the forums for discussion;

    Increase in the number and type of topics covered;

    Use of OMC tools in the context of the social dialogue;

    Search for new ways of establishing connections between different forms and levels of social dialogue.

    Whether this proliferation of 'entry points', arenas and discussion topics will serve to strengthen the actors and improve the results of the European social dialogue remains an open question.

    Ce texte rend compte des transformations importantes du dialogue social dans les années 1990. Deux grandes périodes peuvent être distinguées. La première qui s'inscrit dans la logique de l'accord social de Maastricht annexé au traité de Maastricht (1992), n'a pas réellement engendré les résultats et la dynamique que l'on pouvait en attendre. Le montage institutionnel particulier de la négociation collective à l'ombre de la loi's'avéra être à la fois un atout, mais aussi une source de faiblesse pour le dialogue social. La seconde période, fin des années 1990, frappe par la grande diversification des formes institutionnelles du dialogue social, ce qui devrait multiplier ses chances de succès, même si ces formes sont plus modestes. Quatre grandes évolutions ont vu le jour: la diversification des arènes de discussion; la multiplication des thématiques; un usage des outils de la MOC par le dialogue social; la recherche de nouvelles articulations entre différents lieux du dialogue social. Cette multiplication des "entrées", lieux et thématiques de discussion va-t-elle renforcer les acteurs et améliorer les résultats du dialogue social européen? La question demeure ouverte.
