    El surgimiento del poder constituyente está directamente relacionado con los cambios en la legitimidad del poder político. Su aparición durante el liberalismo revolucionario creó el fundamento de las actuales democracias constitucionales. No obstante, conceptos como poder constituyente y soberanía han sufrido mutaciones en su contenido destinadas principalmente a contener su potencial revolucionario. El nuevo constitucionalismo reivindica un concepto legitimador de poder constituyente, útil para la consolidación del Estado constitucional y para comprender los fenómenos actuales de cambio constitucional.

    The emergence of constituent power is directly related to changes in the legitimacy of political power. His appearance during the revolutionary liberalism created the basis for current constitutional democracies. However, concepts such as constituent power and sovereignty have undergone mutations destined principally to avoid revolutionary potential. The new constitutionalism claims for a legitimazing concept of constituent power, useful for the consolidation of the constitutional State, and to understand current phenomena of constitutional change.
