Una cuestión de incompletitud

    Este artículo procura relacionar la incompletitud del lenguaje con la incompletitud del sistema jurídico. Sabedoras de que ambos se enfrentan con la movilidad, intentamos demostrar nuestro objetivo investigando el lenguaje a partir del silencio fundador explorado por Eni Orlandi y de la doble condición, que es la parte inherente al lenguaje, abordada por Santaella. En el sistema jurídico nos apoyamos en la concepción jurisprudencialista de Castanheira Neves que asume el sistema jurídico y el problema jurídico, ambos, como problemas. Para sustentar nuestra pesquisa, hemos tomado como base a teóricos del lenguaje como Santaella y Orlandi y a teóricos del Derecho, como Castanheira Neves, Barak y Hart.

    This article aims to relate the incompleteness of the language with the incompleteness of the legal system. Aware that both of them deal with mobility, we try to demonstrate our objective by investigating the language from the founder silence reported by Eni Orlandi and the double condition, which is an inherent part of language, suggested by Santaella. In the legal system we focused on rules, principle, problem, jurisprudence, legal dogmatics, trying to establish a dialectical relationship between the system and the problem. To support our research, we focus on language theorists, such as Santaella and Orlandi and theorists of law as Castanheira Neves, Barak and Hart.
