    El presente trabajo tiene por objeto destacar los problemas de constitucionalidad del tipo penal de infanticidio regulado en el artículo 394 del Código Penal chileno, así como plantear la necesidad de modifi car dicha fi gura delictiva en un sentido que tutele adecuadamente tanto los derechos fundamentales del recién nacido, como las garantías constitucionales de la madre. Para ello, se parte de la base de que no basta con suprimir la existencia del tipo penal de infanticidio para superar la inconstitucionalidad de la fi gura, si dicha supresión no va acompañada de un tratamiento punitivo de la mujer que sea acorde con la culpabilidad de la misma.

    This paper aims to highlight the problems of constitutionality within the crime of infanticide regulated in article 394 of the Chilean Criminal Code, as well as to express the need for amending this offense in a way that will safeguard the constitutional rights of the new born and the constitutional guarantees of the mother. In doing so, it assumes that is not enough to eliminate the existence of the crime of infanticide to overcome the unconstitutionality of the fi gure, if such elimination is not accompanied by the punitive treatment of women in line with their own culpability.
