Information and consultation arrangements: results from a transnational study

    This article is based on the INFORMIA study which investigated the nature and extent of information and consultation (I&C) arrangements in four EU Member States (Bulgaria, France, Ireland and Italy) and one candidate country (Croatia). The study analysed not just the I&C procedures arising from the transposition of Directive 2002/14/EC on information and consultation of employees, but also other arrangements of longer standing, such as European Works Councils (EWCs) and the I&C procedure on occupational health and safety issues. It examined the application of I&C arrangements in the participating countries, with a particular focus on rights, responsibilities, methods of electing employee representatives, and the scope of I&C arrangements. Finally, the study examined whether any of the enterprises surveyed had made use of I&C procedures as part of their strategies for dealing with the global economic crisis.

    Cet article est basé sur l'étude INFORMIA qui a examiné la nature et l'étendue des accords conclus en matière d'information et de consultation (I&C) dans quatre Etats membres de l'UE (Bulgarie, France, Irlande et Italie) et dans un pays candidat (Croatie). L'étude n'a pas seulement analysé les procédures I&C découlant de la transposition de la directive 2002/14/CE sur l'information et la consultation des travailleurs, mais aussi d'autres accords de plus longue portée comme les comités d'entreprise européens et la procédure I&C sur les questions de santé et de sécurité au travail. L'article étudie l'application des accords en matière d'I&C dans les pays participants, en se focalisant en particulier sur les droits, les responsabilités, les méthodes d'élection des représentants des travailleurs et la portée des accords conclus. Enfin, il examine si certaines des entreprises concernées ont utilisé les procédures I&C dans le cadre des stratégies qu'elles mettent en ouvre face à la crise économique mondiale.

    Dieser Beitrag berichtet über eine Studie von INFORMIA, die sich mit dem Wesen und Umfang der Regelungen im Bereich der Information und Konsultation in vier EU-Mitgliedstaaten (Bulgarien, Frankreich, Irland und Italien) sowie einem Kandidatenland (Kroatien) befasst. Die Studie analysiert die Informations- und Konsultationsverfahren, die sich aus der Umsetzung der Richtlinie 2002/14/ EG über die Unterrichtung und Anhörung der Arbeitnehmer ergeben, aber auch ältere Verfahren wie etwa im Rahmen der Europäischen Betriebsräte (EBR) und im Arbeitsschutzbereich. Bei der Analyse der Umsetzung dieser Regelungen wird der Schwerpunkt auf Verantwortlichkeiten, Modalitäten für die Wahl der Arbeitnehmervertreter und Umfang dieser Regelungen gelegt. Schließlich wird in der Studie untersucht, ob die befragten Unternehmen Informations- und Konsultationsverfahren im Rahmen ihrer Strategien zur Bewältigung der Weltwirtschaftskrise genutzt haben.
