La Ley I/91, de 7 de enero, de modificación de los Códigos Civil y Penal en materia de responsabilidad civil del profesorado reformando el artículo 1903 y 1904 del primero y el artículo 22 del segundo, actualizan plausiblemente la responsabilidad civil del profesorado por los actos ilícitos de sus alumnos. Sin alterar la naturaleza jurídica de los mencionados preceptos, la responsabilidad civil se traslada del profesor al titular del Centro Docente, circunscribiendo los hechos al ámbito de la enseñanza no superior, alumnos menores de 18 años, a los períodos de tiempo en que éstos se mantengan bajo vigilancia a control de los profesores y tanto durante las actividades escolares como extraescolares o complementarias, pero introduciendo una nueva y específica acción de repetición del titular de centro contra el docente que hubiera incurrido en dolo o culpa grave en el desempeño de sus obligaciones.

The I/91 Law, dated on the 7th of Junuary, that intends to modify the Civil and Penal Codes regarding Civil Responsability of the teacher, laudably updates the teacher's civil responsabilities as regards to the illegal acts produced by his pupils. This modification has been carried out by reforming the articles 1903 and 1904 of the Civil Code and the 22 nd article of the Penal Code. Without meaning to alted the juridical nature of the precepts we have mentioned, civil responsability now transfers itself from the teacher to the teaching institution's official. This responsability is restricted only to the matters dealing elementary and secondary education and also to those periods of time in which these pupils -under 18- are controled by the teachers during either scholar, extra-scholar or complementary activities. This new civil responsability introduces a new specific repetitive action of the Institution Official against the educator who may have committed fraud or severe fault while performing his duties.
