    La LC introduce a nivel estatal la posibilidad de constituir sociedades cooperativas de carácter mixto. No estamos ante una nueva clase de cooperativas, sino que se contempla como una posible “forma de ser” de la cooperativa. Se trata de una fórmula cooperativa que contiene una mayor aproximación a las sociedades de capitales, que se manifiesta en la regulación de un socio aportante de capital cuyo estatuto pivota, fundamentalmente, sobre dicha aportación; por este motivo se ha realizado un análisis comparativo entre las acciones y las partes sociales con voto al objeto de profundizar en el régimen jurídico de éstas últimas. No podemos olvidar que la propia LC nos remite a la legislación de las sociedades de capital para integrar el régimen jurídico de las partes sociales con voto.

    The LC introduced at the state level, the possibility of establishing cooperative societies of mixed character. We aren´t facing a new kind of cooperative, but we viewed as a possible “way of being” cooperative.

    It is a cooperative formula which comes closer to stock companies, as is self evident in the regulation of a capital-contributing partner whose status pivots mainly on such contributions. For that reason we’re making a comparative analysis between “joint stock limited company shares” and the “social voting shares”, in order to deepen the legal status of these latter. We must not forget that the Spanish Cooperative Societies Act itself refers us to the Law of limited liability companies to integrate the legal status of the company's shares without voting
