  In this paper I examine the evolving role of constitutional law and courts as religion-harnessing agents in Israel and Malaysia -two complex constitutional settings, "ethnic democracies" by some classifications -that occupy the largely uncharted middle-ground between a strict separation of religionandstate,andafull-fledged "constitutional theocracy". As I show, a combination of instrumentalist and systemic factors, most notably the embedded " statist" inclination of the constitutional domain, generate landmark jurisprudence that supports a nationalized, state-endorsed variant of religion and at the same time disarms religion of its radical edge and brings it under constitutional check. As a result, the constitutional domain in these and other similarly situated countries has become an attractive arena for those who oppose the expansion of religion-based morality beyond the boundaries of the canonical national meta-narrative.

  Cet article examine l'évolution du rôle du droit constitutionnel et des juridictions suprêmes dans la régulation du religieux en Israël et en Malaisie -deux cadres constitution- nels complexes de "démocraties ethniques"-occupant une position intermédiaire peu explorée entre régime de stricte séparation entre État et religions et "théocratie constitutionnelle"à part entière. Une combinaison de facteurs instrumentaux et systémiques, en particulier la tendance « étatiste » inhérente au champ constitutionnel, est à la source d'une jurisprudence dont les décisions les plus marquantes confortent une variante nationalisée de la religion, validée par l'État ; les cours constitutionnelles dépossèdent la religion de sa dimension radicale et la placent sous contrôle constitutionnel. Dans ces pays et d'autres du même type, le champ constitutionnel représente par conséquent une arène attractive pour les groupes sociaux qui s'opposent à l'expansion d'un droit fondé sur une normativité religieuse dépassant les frontières du métarécit national de référence.
