    • The essay takes as its starting-point the legal conflict in tenns of tbe Concordat which arose over the appointment of Hans Barion to a chair in Municb. The Reich Ministry for Education and Culture and the Academy of German Law together advanced an interpretation of the Nihilobstat agreement contained in the Bavarian Concordat of 1924 which placed their ecclesiastical partner in the Concordat at a disadvantage in order to increase the influence of the NS State over theological training. Those directly affected, such as Barion, and the representatives of the Reich Ministry within the framework of the Academy of German Law were direct participants in the conflict. Even after 1945 its outcome continued to be recognized.
