An analysis of the relationship between cohabitation and Constitution has led to the elaboration and implementation of a judicial method to study the relative nature of the efficiency of the law. It shows that the Constitution has been violated even in periods of cohabitation and that the main reason for the inefficiency of the Constitution is to be found in the combination of several constraints linked to the right to dissolve the Assembly. In order to guarantee the respect of the Constitution it might be necessary to amend it.

L’analyse des relations entre cohabitation et Constitution a permis d’élaborer et d’appliquer une méthode juridique pour l’étude de la relativité de l’effectivité des règles. Elle montre que la Constitution a pu être violée même en période de cohabitation et que la cause fondamentale de cette ineffectivité de la Constitution réside dans la combinaison de plusieurs contraintes autour du droit de dissolution. Pour garantir le respect de la Constitution, il sera peut-être nécessaire de la réviser sur ce point.
