Resumen de La demanda marítima de Bolivia en La Haya: entre el pacta sunt servanda y la promisio est servanda

  El presente trabajo busca explicar los factores y causas que han motivado la decisión boliviana de presentar una demanda contra Chile ante la Corte Internacional de Justicia, así como los fundamentos históricos y jurídicos que ha presentado ante esta instancia internacional. La evidencia histórica muestra un proceso, de largo aliento, en el que la cuestión marítima de Bolivia ha estado presente en al agenda bilateral; sin embargo, de un tiempo a esta parte, Chile ha venido señalado que no existen temas pendientes que negociar con su vecino.

  Esto ha detonado en que Bolivia abra un nuevo escenario, de tipo jurisdicional, en el que busca demostrar, que su país vecino tiene una obligación de negociar, de buena fe y en un plazo razonable, a fin de alcanzar un acuerdo que le otorgue una salida plenamente soberana al Océano Pacifico. Así que respetando la vigencia del Tratado de Paz de 1904 (pacta sunt servanda) con el que se puso fin a la guera del Pacífico, se pide el cumplimiento de lo ofrecido (promisio est servanda), una negociación pendiente.

  This paper seks to explain the causes and factors that have led to the decision to submit a Bolivian demand against Chile before the International Court of Justice, as wel as the historical and legal foundations that has ben presented to this international body. The historical evidence shows a proces, long breath, in which the maritime isue of Bolivia has ben present in the bilateral agenda; however, for some time now, Chile has ben pointed out that there are no outstanding isues to negotiate with your neighbor. This has detonated in Bolivia that open a new scenario, jurisdictional type, in which seks to demonstrate, that your neighbor has an obligation to negotiate in god faith and in a reasonable time, in order to reach an agrement that gives you a fuly sovereign outlet to the Pacific Ocean. So while respecting the validity of the Peace Treaty of 1904 (pacta sunt servanda) which put an end to the war of the Pacific, cals for implementation of the ofered (promisio est servanda), a pending negotiation.
