Cuando investigamos solemos olvidar que las herramientas que utilizamos no han surgido espontáneamente, sino que las ha construido un saber/poder y se han transmitido a través de nuestro sistema de enseñanza. Eso es, en el ámbito del Derecho Constitucional, lo primero que se analiza en este trabajo, con dos objetivos: Para ver algo que todavía permanece invisible, quién y cómo es el sujeto sobre el que se ha construido el Derecho Constitucional -un hombre, blanco, propietario y heterosexual- y la influencia de esa pre-decisión en todo el ordenamiento jurídico y en la formación de nuestra personalidad; y para desvelar la imposibilidad de una igualdad de mujeres y hombres en un sistema así construido. Todo ello para aclarar que el que los derechos sexuales y los derechos reproductivos estén pendientes de un hilo en este momento no es más que una consecuencia directa del propio sistema.

When we investigated, we often forget that the tools we use have not arisen spontaneously, but that a knowledge/power has built them, and they have passed through our education system That is, in the field of constitutional law, the first thing discussed in this work, with two objectives: To see something that still remains invisible, who and how is the subject on which the constitutional law has been built -a man, white, owner and heterosexual- and the influence of this pre-decision on all the legal system and in the formation of our personality; and to reveal the impossibility of equality of women and men in a system that has been built like this. All of this to clarify that sexual rights and reproductive rights are pending a thread at this time is simply a direct result of the system itself.

Askotan gauzak ikertzen direnean ahaztu egiten da hori egiteko ditugun baliabideak ez direla berez sortu, baizik eta jakintza eta aginte edo botere batek sortu dituela eta gure hezkuntza-sistemak hedatu dituela. Hori da lantzen den lehenengo gauza Konstituzio Zuzenbidearen alorrari lotuta, bereziki, bi helburuekin: Konstituzio Zuzenbideak oinarritzat hartu duen subjektuaren ezaugarriak -gizonezkoa da,zuria, jabea eta heterosexuala- eta nolako eragina izan duen aurrerabaki horrek zuzenbide-antolamendu osoan eta norberaren nortasunean ikusteko, ikusezina baita gure sisteman;eta azaltzeko nola bilakatzen den ezinezkoa emakumeen eta gizonen berdintasuna, horrela eraiki den sistema horretan. Sexu-eskubideak eta ugaltze-eskubideak kolokan egotea sistemaren beraren ondorio zuzena baino ez dela, argi uzteko asmoaz.
