Resumen de La ejecución provisional de la pena sustituida por expulsión o derecho a la libertad del extranjero en prisión preventiva

Desde la perspectiva de un caso real ligado al ejercicio profesional de la abogacía, se analizará la situación de un extranjero a partir de su ingreso en prisión provisional hasta su expulsión, con especial énfasis en las razones que podrían justificar la ejecución provisional de una pena privativa de libertad sustituida en sentencia por la expulsión del territorio nacional, cuando el foráneo no ha interpuesto recurso de apelación contra la sentencia ni se ha adherido al recurso presentado por otro condenado, en este caso, ciudadano comunitario.
Y, acto seguido, se abordará el supuesto por el cual, si el condenado permanece en prisión preventiva sin ejecutarse la expulsión acordada en la pertinente resolución judicial, procederá irremediablemente su inmediata puesta en libertad.
