La cooperativa en el nuevo constitucionalismo latinoamericano: probables contribuciones al perfeccionamiento de su regulación constitucional en Cuba

El objetivo de este trabajo es sistematizar los rasgos que caracterizan la regulación de la cooperativa en el nuevo constitucionalismo latinoamericano y que, en tal sentido podrían contribuir al perfeccionamiento del magno texto cubano. Para ello se comienza explicando el origen histórico y las tendencias de la constitucionalización de la cooperativa, así como los aspectos que —a juicio del autor— debería contener dicha constitucionalización. Sobre esta base se valoran, en un segundo momento, las limitaciones de la cooperativa en la Constitución socialista cubana. Por último, se identifican en tres de los textos representativos del nuevo constitucionalismo latinoamericano (Venezuela, Ecuador y Bolivia), aquellos elementos que podrían contribuir al perfeccionamiento de la regulación constitucional de la figura en Cuba.

The objective of this work is to systematize the features that characterize the regulation of the cooperative in the new Latin-American constitutionalism, those that could contribute to the improvement of the Cuban constitutional text. In order to do so it begin explaining the historical origin and the tendencies of the legal regulations of the cooperative in the Constitutions, as well as the aspects that —in the author’s opinion— should contain this constitutionalisation. On this base they are valued, in a second moment, the limitations of the cooperative in the Cuban socialist Constitution. Lastly, it identifies in three of the representative texts of the new Latin American constitutionalism (Venezuela, Ecuador and Bolivia), the elements that could contribute to the improvement of the constitutional regulation of the figure in Cuba.
