  Com o surgimento do Estado Democrático e Constitucional de Direito, em substituição ao Estado de Direito em sua versão meramente legislativa, inúmeras foram as transformações ocorridas. Uma das mais evidentes se dá na atividade jurisdicional. Se antes o Juiz era apenas a manifestação da vontade do legislador, hoje seu espaço de atuação mudou. Ganhou em autonomia e liberdade de interpretação, mas sempre tendo por objetivo um único rumo: a garantia dos direitos fundamentais. Exsurge, nesse cenário, sua atuação no direito ambiental. Com sua proteção erigida a direito fundamental, novos instrumentos foram necessários para a sua concretização. Dentre eles, destaca-se o princípio do poluidor-pagador, manifestação clara e evidente de intervenção no espaço privado em nome da defesa do patrimônio coletivo.Palavras-chave: Estado democrático de direito, função jurisdictional, meio ambiente.

  With the emergence of the Democratic State and Constitutional Law, replacing the Rule of Law in its purely legislative version, innumerous transformations have taken place. One of the most obvious occurred at the court activity. Before the Judge was just the manifestation of the will of the legislature, today his work space has changed. It has gained autonomy and freedom of interpretation. However, its objective has focused in one direction: the guarantee of the fundamental rights. In this scenario, it raises its performance in environmental law. With its fundamental right to protection erected, new instruments were needed to achieve them such as the polluter pays principle, clear manifestation and intervention in the private sphere defending the collective heritage.Key words: Democratic rule of law, jurisdictional function, environment.
