    O texto aborda o direito ao trabalho e o direito do trabalho fundamentados no Protocolo de San Salvador, que faz parte da Convenção Americana sobre Direitos Humanos, o “Pacto de San José da Costa Rica”. O trabalho e a legislação trabalhista, inseridos no rol dos direitos humanos e, no sistema constitucional brasileiro, no âmbito dos direitos e garantias fundamentais, têm como objetivos a busca do Estado Democrático de Direito e da justiça social, fundamentos de uma sociedade justa e fraterna. A problematização está ligada ao impacto social, positivo ou negativo, da regulação dos direitos ao trabalho e do trabalho, tanto no sistema jurídico interno (como direitos e até princípios fundamentais), quanto no âmbito internacional como direitos humanos (especialmente no Protocolo de San Salvador). Objetiva-se, portanto, demonstrar que a regulação dos direitos ao e do trabalho faz parte de um amplo contexto social de direitos.Palavras-chave: Convenção Americana de Direitos Humanos, direito do trabalho, direitos sociais, normas Internacionais, Protocolo de San Salvador.

    This paper addresses the right to work and labor law based on the San Salvador Protocol, which is part of the American Convention on Human Rights, the “Pact of San Jose, Costa Rica”. The goal of labor and labor legislation, inserted in the list of human rights and, in the Brazilian constitutional system, in the realm of the fundamental rights and guarantees, is the pursuit of the democratic rule of law and social justice, foundations of a just and fraternal society. The article’s questioning is related to the social – positive or negative – impact of the regulation of labor rights and labor, both in the domestic legal system (such as rights and even principles) and in the international sphere as human rights (especially in the San Salvador Protocol). Its objective is, therefore, to demonstrate that the regulation of the right to work and of labor law is part of a broader social context of rights.Keywords: American Convention on Human Rights, labor law, social rights, international standards, Protocol of San Salvador.
