La importancia que tienen en la vida diaria los actos de jurisdicción voluntaria no encuentran su correlato en una regulación precisa y moderna. En el ámbito del reconocimiento de resoluciones extranjeras se traduce en una enorme incertidumbre en cuanto al procedimiento a seguir y los controles a realizar. En muchas ocasiones los efectos que las resoluciones extranjeras deben desplegar en España tienen lugar en el ámbito registral. La nueva Ley del Registro prevé un precepto sobre esta cuestión. Conviene que la nueva Ley de Jurisdicción Voluntaria regule este aspecto de forma coherente con dicha norma y que sea muy precisa y clara al establecer el reconocimiento en otras situaciones.

Despite the importance of the non-contentious jurisdiction resolutions in the legal relations, we have not a clear and modern regulation on it. This is particularly evident when we try to recognize the effects of foreign resolutions. There is a huge uncertainty about the procedure and controls to perform. In many cases the effects of foreign judgments take place in the Civil Register. The new Spanish Act of �Registro Civil� provides for rules on this issue. It would be advisable that the future Non-Contentious Jurisdiction Act regulate this aspect consistently with those rules and in a very precise and clear way.
