The article reports on the amended restructuring law in Switzerland which introduced a duty to implement a social plan in case of mass dismissals. A summary of the criteria for employers to negotiate a social plan with a trade union in addition to a collective employment agreement are outlined. Questions relating to the content of a social plan are raised including the interpretation of the term set out measures to avoid redundancies or to reduce their numbers.
