  • The article discusses lessons private equity and hedge fund firms can learn about the risks of the U.S. Foreign Corrupt Practices Act (FCPA) Libya. Topics discussed are the risk of soliciting investments from sovereign wealth funds, the risk of using third-party placement agents, marketers and other intermediaries in dealing with sovereign wealth funds, and the risk for violations committed by portfolio firms. Strategies to minimize risk exposure to FCPA violations are offered.
