  • The article focuses on a proposal to amend the bankruptcy law in Spain in a bid to make it easier for ailing companies to avoid liquidation. Topics discussed include problems posed by provisions relating to the potential liability of directors and shareholders that vote against a capital increase, and the lack of similar provision for capitalisation proposals put forward by the creditors once the company has been declared insolvent.
