La porción legítima constituye una institución jurídica propia del Derecho de sucesiones que, en la configuración actual de los ordenamientos jurídicos pertenecientes a la familia romanística del Derecho, es el resultado de la fusión de dos instituciones precedentes:
por un lado, la porción legítima romana; por otro, la reserva familiar germánica. Ambos ingredientes estuvieron presentes en la codificación francesa, la cual como en otras materias, sirvió de referencia a otros muchos ordenamientos jurídicos.
