    Históricamente, ha sido de suma importancia solucionar el problema de refugiados y asilados en América Latina. Al respecto, los avances jurídicos a través de instrumentos internacionales han sido fructíferos. Sin embargo, solo hasta el año de 1999 hubo una unificación al respecto. Esto no significa que en la actualidad, no existan problemas al reconocer los derechos de asilo y refugio. Los desafíos que se presentan para otorgar estos derechos, son muchos; sin embargo, no todo está dicho. En este artículo se observarán los avances, los desafíos y recomendaciones sobre el tema de asilo y refugio, con el fin de superar y proteger la vida y dignidad humana, propósito de estas figuras.

    Historically, dealing with the problem of the refugees and asylees has become an extremely important topic in Latin America. So far there have been fruitful juridical international advances on this matter. Nevertheless, it wasn’t until 1999 when there was a unification of criteria on this topic. This does not mean that nowadays we do not have problems when trying to recognize the asylum and refugee rights. The challenges that arise when granting these rights are plenty; however, this is not final. This article deals with the advances, challenges, and suggestions on asylum and refugee, in order to overcome and protect life and human dignity, which is the purpose of the aforementioned rights.
