  Este trabajo responde a la línea de investigación en “problemas jurídicos contemporáneos” y constituye un avance del proyecto de investigación en ejecución titulado: “El problema de la validez y del actual sistema de fuentes en el derecho colombiano”. Si bien el proyecto tiene como propósito desarrollar un examen crítico del concepto de validez y estudiar el actual sistema de fuentes en el derecho colombiano luego de la expedición de la Constitución Política de 1991, por constituir un avance, este artículo solo se limita a desarrollar el primer aspecto; esto es el problema del concepto de validez jurídica en las corrientes de pensamiento iusnaturalista y positivista.

  This work responds to the research line on “contemporary legal issues” and is a breakthrough of the research project in place titled “the validity problem of the current sources’ system in the Colombian law”. Even though the project’s purpose is to develop a critical assessment of the validity concept as well as study the current sources’ system in the Colombian Law following the promulgation of the 1991 Political Constitution as a step forward, this article aims only at developing the first aspect; this is the legal validity concept issue in the currents of iusnaturalist, positivist and neoconstitutionalist thoughts.
