Resumen de O conceito de educação, liberdade de expressão e a participação da comunidade nas eleições escolares

  This essay aims to explore the relations between educational law, freedom of speech and the right to elect public school manager. The problem: is the education as it appears in the Brazil’s Constitution is linked to the freedom of speech, and to the democratic foundations of the republic? That implies that the public school manager should be elected – an interpretation that is contrary to the one made by the Brazil’s Supreme Court. The objective is to analyze the concept of education, the freedom of speech and the public school manager election. The theme is socially relevant, once the constitution establish the democratic system to the school environment.

  The theoretical grounding will be the pragmatic-systemic and the methodology will be monographic.

  Este ensaio busca explorar as relações entre Direito Educacional, liberdade de expressão e o direito de eleger o diretor de escola pública. O problema é: a educação, como aparece na  Constituição, está conectada com a liberdade de expressão e  com os parâmetros democráticos da república brasileira? Isto  implica na hipótese de que o administrador escolar deve ser  eleito – uma interpretação que é contrária a feita pelo Supremo  Tribunal Federal. O objetivo é analisar o conceito de educação, a liberdade  de expressão e o a eleição do diretor escolar. O tema é  socialmente relevante, uma vez que a Constituição normatiza o  ambiente escolar como democrático. A matriz teórica será a  pragmática-sistêmica e a metodologia será monográfica.
